الخلع ومسكن الزوجية
بعد قيام الزوجة برفع دعوى خلع فالسؤال الشقة من حق مين فى هذه الحاله ؟ , -الخلع ومسكن الزوجية – هيكون موضوعنا اليوم ….
الفرق بين أجر المسكن والتمكين :
- من الممكن اذا تم الطلاق بشكل ودى ان تطلب الزوجه أجر للمسكن بدلا من شقة الزوجيه .
- وهنا يتم كتابة عقد اتفاق بين الزوجين على حصول الزوجة على أجر مسكن وتنازلها عن شقة الزوجيه ..
- اما اذا قامت الزوجه برفع دعوى الخلع فهذا يعنى بشكل غير مباشر انه لا يوجد اتفاق بينها وبين الزوج , وعليه فانها من الممكن ان تطلب التمكين من شقة الزوجية وهنا تظهر علاقه الخلع ومسكن الزوجية .
- حتى مع الخلع الزوجه اذا كانت حاضنه تحصل على شقة الزوجيه بناء على قرار تمكين من النيابه العامة , ومن الممكن ان ايضا ان تطلب اجر المكسن والخيار للزوجه .
وهل هناك بين الخلع ومسكن الزوجية :
- العلاقه تظهر فى حاله وجود اطفال لانه فى هذه الحاله الزوجه تكون حاضنه .
- ودا معناه انها من الممكن ان تطلب التمكين من شقة الحضانه .
والسؤال هل يحق للزوج الغاء قرار التمكين بعد حصول الزوجه عليه ؟

• If the wife filed the khula lawsuit, this indirectly means that there is no agreement between her and the husband, and accordingly, she may request empowerment from the marital apartment, and here the relationship of khula and the marital home appears.
• Even with khul`, the wife if the incubator gets the marital apartment based on the empowerment decision of the Public Prosecution, and it is also possible for her to ask for the wage of the acquirer and the choice for the wife.
And is there between khula and the marital home:
• The relationship appears in the case of having children, because in this case the wife is an incubator.
• This means that she may ask for empowerment from the nursery apartment.
The question is, does the husband have the right to cancel the empowerment decision after the wife gets it?
