آثار الطلاق
آثار الطلاق من الناحيه القانونيه على كل من الزوج وكذلك على الزوجه .ومن الذى يخسر ماديا من آثار الطلاق فى القانون المصرى .
الطلاق عن طريق المحكمه :
- عند رفض الزوج ايقاع الطلاق يتم رفع الزوجه دعوى للطلاق .
- سواء كانت دعوى طلاق للضرر أو الخلع .
- وهنا نفرق بين آثار الطلاق فى كل دعوى .
- ففى الخلع تتنازل الزوجه عن كافة مستحقتها الماليه من نفقة عده متعه مؤخر .
آثار الطلاق فى الطلاق للضرر :
- الوضع مختلف عند رفع دعوى التطليق ضرر .
- لان الزوجه هنا تحافظ على كافة مستحقتها كأثر من آثار الطلاق فى هذه الدعوى .
- والذى تحافظ على الزوجه تحديدا .
- نفقة المتعه والعدة والمؤخر.
- بخلاف باقى الحقوق الاخرى .
وهنا يكون الطلاق مرهق ماديا للزوج عند اختيار الزوجه طريق الطلاق للضرر لانها بتاخذ كافه حقوقها الشرعيه .
